These terms set forth the service conditions that dictate your interactions with Taya, encompassing its brands, products, and offerings, which are collectively termed as "Taya Services" or "Services". By accessing or utilizing the Taya Services, you agree to abide by these Terms. For a summary of the main points:
1.You need to be at least 18 years old to access Taya Services.
2.We are not responsible for the posts or statements you make on Taya, nor do we oversee the content of the app. However, we may remove any content that we consider inappropriate if notified.
3.For questions regarding the use of your data, please review our Privacy Policy, which details how we manage and safeguard your personal information. By using Taya, you agree to the data practices outlined in the Privacy Policy.
4.You consent to refrain from using Taya for any unlawful, deceptive, harmful, or discriminatory actions.

Taya is a free social application offering network chat and live streaming services. You agree to utilize Taya in line with its intended use and these terms and conditions.
The Terms are applicable whenever you use Taya, regardless of whether you are registered. By accessing, using, registering for, or receiving services through Taya (the "Services"), you accept and agree to adhere to these Terms.

1.Privacy
Your privacy is very important to us. Our Privacy Policy details how you can share your information on Taya and how we gather and utilize your content. We recommend reviewing the Privacy Policy to make informed decisions.
2.Sharing Your Content and Information
You can upload different types of content ("Content") to Taya. You retain ownership of all the content and information you upload, and you can control its sharing through your "Privacy" and "Application Settings". However, there are rules to follow. When using Taya, do not post or transmit any content that:
(1).Includes inappropriate language or profanity that could offend, upset, embarrass, alarm, or annoy others;
(2). Is vulgar, sexually explicit, or otherwise disrespectful to human dignity;
(3). Is hostile, derogatory, threatening, or advocates or supports racism, sexism, hatred, or discrimination;
(4). Promotes unlawful activities, including terrorism, racial hatred, or other criminal acts;
(5). Is libelous;
(6). Pertains to commercial activities (such as sales, contests, advertisements, links to other websites, or premium phone numbers);
(7). Includes sending "junk" mail or "spam";
(8). Contains malware, viruses, corrupted files, worms, or other harmful code intended to disrupt or damage software, hardware, networks, servers, or any other equipment, or any material designed to intercept or misuse data;
(9). Violates any third party's rights (including intellectual property and privacy rights);
(10). Shows drugs or drug use;
(11). Includes political material;
(12). Displays another person without their permission;
(13). Contains any material considered inappropriate or unacceptable by Taya;
(14). Concerns information or remarks about individuals under 18 years of age;
(15). While we appreciate your feedback or suggestions about Taya, please be aware that we may use them without offering compensation, and you are not required to provide them.
Please use discretion when choosing the content you post or send through Taya, as you are entirely responsible for and accountable for that content.
3.Protecting Other People's Rights
We honor others' rights and strive to maintain a safe environment on Taya, and we expect you to do likewise.
(1). You must not upload or perform any actions on Taya that violate others' rights or contravene the law.
(2). We retain the right to remove any content or information you post on Taya if we find it violates these Terms or our policies.
(3). If we remove your content for violating someone else's copyright and you think it was a mistake, we will give you a chance to appeal.
(4).If you repeatedly infringe on others' intellectual property rights, we may deactivate your account if needed.
(5). You must not use our copyrights, trademarks, or any similar marks without explicit written authorization from us.
(6). When collecting information from users, you must: obtain their consent, clearly indicate that you (not Taya) are gathering their information, and provide a privacy policy outlining what information you collect and how it will be used.
(7). You must not upload any identification documents or sensitive financial information on Taya.
(8). You must not tag users or send email invitations to individuals who are not users without their consent.
4.Registration and Account
Taya users are required to provide a nickname, age, gender, avatar, and other optional information, and we need your assistance in maintaining these requirements. We offer three methods to access Taya: Facebook, Google, and SMS. Here are some commitments you make to us regarding the registration and security of your account:
(1). You must be 18 years of age or older to use Taya.
(2). You cannot transfer your account to another person without first obtaining our written consent.
(3). You are not allowed to provide any false personal information on Taya or create an account for someone else without proper authorization.
(4).If your account is disabled, you are limited to communicating solely with our official support team, referred to as the "Taya Team," and are not permitted to post any other content.
(5). We reserve the right to delete or ban your account if we consider it necessary.
5.Termination
If you violate the Terms or otherwise present a risk or potential legal liability to us, we reserve the right, at our sole discretion, to:
(1). suspend or terminate your registration (if applicable) and your ability to access or use Taya or submit any Content to Taya; and
(2). utilize any operational, technological, legal, or other measures available to enforce the Terms (including but not limited to blocking specific IP addresses).
We will make an effort (though are not required) to inform you if your access to Taya and/or your Profile is suspended or terminated.
If you have registered on Taya, you can terminate your registration at any time by going to the "Settings" section on Taya while logged in and selecting the "Delete Account" option. We retain your profile information in case you decide to reactivate your account later. Many users temporarily deactivate their accounts and expect us to keep their information until they return to Taya. Consequently, you can fully restore your account and profile within 30 days of deactivation. Once your registration is terminated, we reserve the right to remove any Content you have submitted or uploaded to Taya. For further details, please refer to our Privacy Policy. Content you have uploaded to Taya, excluding your Profile (such as Moments, Comments, or Contacts), may still be visible on Taya after your registration is terminated.
6.In App Purchase and Subscription
In-App Purchases: From time to time, Taya may offer additional products and services for purchase through the App Store℠, Google Play, or other app platforms ("in-app purchases"). If you choose to make an in-app purchase, you will need to provide details for your account on the mobile platform you are using (e.g., Apple, Android, etc.) ("your IAP Account"), and your IAP Account will be billed for the purchase according to the terms given at the time of purchase, as well as the general terms for in-app purchases associated with your IAP Account. If you purchase a subscription with auto-renewal via an in-app purchase, your IAP Account will be charged on a recurring basis until you cancel according to the platform's terms. 7.What can I buy on Taya?
Taya offers the option to pay for certain services available on the platform. Their VIP services provide various advantages, including opportunities to connect with more people, customize your profile, and boost your profile visibility to attract additional users. You can purchase these VIP services after registering, with subscription options available for various time periods. Once you have paid for any VIP services, they are non-refundable. You can modify your Auto Top-up settings at any time through the payment settings on your profile page. Pricing may vary due to factors such as promotional offers, loyalty rewards, and other discounts that may apply to your age group.
8.How do I renew my VIP services with Taya?
When you request Taya VIP Service, you authorize Taya to charge your chosen payment method. To cancel or adjust your payment method at any time, you can do so through the payment settings in your profile or by contacting your mobile service provider. If your payment method is managed through your mobile service provider, please review their payment terms, as these will determine how payments to Taya are processed and how they can be modified or canceled. Your Taya VIP service subscription will renew automatically until you opt to cancel, and if you have activated the auto top-up feature, your account will be replenished automatically until you decide to disable this feature.
9.Subscription Tips
(1). Subscriptions will renew automatically unless the auto-renew option is turned off at least 24 hours before the current billing cycle concludes.
(2). The account will be charged for renewal within 24 hours prior to the end of the current period, and the cost of renewal will be indicated.
(3). Users can manage their subscriptions by turning off auto-renewal through the Account Settings after making a purchase.
(4). Cancellation of the current subscription is not allowed while the subscription is active.
10.Virtual Currency
(1). Taya offers a feature enabling users to purchase virtual currency known as "Taya Coins" for use within the Service (e.g., to "tip" a Taya Broadcaster during a live show or to send Gifts to friends in chat). You understand that any distribution of Coins from your account, such as a virtual "tip" to another user's account, is completely at your discretion. Once you authorize a transfer of Coins to another user's account, it cannot be undone, and the Coins cannot be withdrawn.
(2). Coins are digital assets that can be acquired through various online payment methods such as Credit Card, Debit Card, Bank Transfer, Wallet, Google Payments, iTunes Payments, and others. The value (conversion rate) of the Coins, the payment methods, and any additional terms for obtaining Coins will be determined by Taya based on your country of residence. Taya also reserves the right to modify the conversion rate between real currency and virtual Coins at its discretion, with or without prior notice. By using the Service, you agree to the applicable conversion rate of any Coins at the time of your purchase.
(3). Coins acquired are intended exclusively for lawful purposes within the Service and must adhere to all applicable regulations. Coins cannot be redeemed or utilized for cash, assets, or other financial advantages beyond the services and Content offered by Taya. The quantity of Coins required for accessing services or Content, along with other conditions related to Coin transactions, will be outlined by Taya on the Platform.
(4). You recognize that buying Coins involves real money, which must be acquired legally and free from any disputes, and that it will not be linked to any unlawful activities or illicit gains, either now or in the future. If you have any objections to, or do not completely understand, our conversion rate policy, or cannot guarantee the legality of your actual currency, please refrain from purchasing or using Coins with the Service.
(5). You acknowledge that Taya may periodically change, amend, or update these Terms of Use or the terms of sale concerning Coins, and such changes will be applicable to all future Coin purchases. You agree to review these Terms of Use and any associated terms prior to making any purchase.
(6).If Taya closes your account for any reason, any remaining Coins in your account at the time of closure may be forfeited and will not be retrievable, at Taya's sole discretion.
(7). Coins will not be refunded or contested under any conditions; however, this does not apply if mandated by applicable laws and regulations. In such instances, Taya will establish the refund or dispute resolution procedure in accordance with relevant laws and regulations, and this information will be made available on the Platform. Typically, if a refund or dispute request is submitted, the related ID and Device will be permanently banned, and any diamonds obtained from the Coins will be deducted.
11.Advertising/Promotions
Certain Taya Services are funded through advertising revenue and may display ads and promotions. By using these services, you consent to Taya placing such ads and promotions within the Taya Services or around, alongside, or in connection with your Content. The type, method, and extent of these ads and promotions may change without prior notice to you.
12.Abuse/Complaints
You can report any misuse or concerns regarding content on Taya. We provide both "Block" and "Report" options to help us maintain a clean and secure environment on Taya. To report a user, simply click "Report" on their profile and select the reason for your complaint. You can also report a moment by clicking "Report" on the moment's detail page and choosing the reason for the report. All reports will be reviewed by our "Audit Team," who will take appropriate action in accordance with our policies. If you believe an issue was addressed improperly, you can appeal by using "Feedback" at [email protected]. We are dedicated to resolving any issues you may experience with our service.
13.Proprietary Rights in Content on Taya
(1). Taya does not claim any ownership rights over the text, files, images, photos, videos, sounds, musical compositions, authored works, applications, or any other materials (collectively, "Content") that you submit through the Taya Services. By uploading any Content on or through the Taya Services, you grant Taya a non-exclusive, fully paid, royalty-free, global, limited license to use, modify, remove, add to, publicly perform, publicly display, reproduce, and translate such Content. This includes distributing part or all of the Site through any media formats or channels, except that Content designated as private will not be distributed beyond the Taya Services.
(2). You confirm and warrant that: (i) you either own the Content you post on or through the Taya Services or have the necessary rights to grant the license outlined in this section, (ii) the posting and use of your Content on or through the Taya Services do not violate any privacy rights, publicity rights, copyrights, contractual rights, intellectual property rights, or any other rights of any person, and (iii) posting your Content on the Site does not breach any agreements you have with third parties. You agree to cover all royalties, fees, and other payments owed to any party due to the Content you post on or through the Taya Services.
(3). The Taya Services encompass Content owned by Taya ("Taya Content"). Taya Content is safeguarded by copyright, trademark, patent, trade secret, and other laws, with Taya maintaining all rights to the Taya Content and the Taya Services. Taya grants you a limited, revocable, non-transferable license to reproduce and display the Taya Content (excluding any software code) solely for personal use in connection with viewing the Site and using the Taya Services.
(4). The Taya Services include Content from Users and other Taya licensors. Unless specified in this Agreement, you are not allowed to copy, alter, translate, publish, broadcast, transmit, distribute, perform, display, or sell any Content available on or through the Taya Services.
(5).Taya performs technical operations essential for delivering the Taya Services, including but not limited to transcoding and/or reformatting Content to facilitate its use across the Taya Services.
(6). While the Site and other Taya Services are generally available, there may be times when the Site or other Taya Services are temporarily inaccessible due to scheduled maintenance or upgrades, emergency repairs, or disruptions in telecommunications links and equipment beyond Taya's control. Additionally, although Taya typically removes Content that violates this Agreement, Taya retains the right to remove any Content for any reason, without prior notice. Deleted Content may be retained by Taya to comply with legal obligations and cannot be recovered without a valid court order. Consequently, Taya advises you to keep your own backup of your Content. In other words, Taya is not a backup service and will not be responsible for any modifications, suspensions, or terminations of the Taya Services, or for any loss of Content.
14.Disclaimer of warranties and limitation of liability
To the maximum extent permitted by law, Taya explicitly disclaims:
(1). any conditions, representations, warranties, and other terms that could otherwise be implied by statute, common law, or equity principles; and
(2).any liability incurred by you resulting from the use of Taya, its services, or these terms and conditions, including but not limited to any claims, charges, demands, damages, liabilities, losses, or expenses of any kind and however caused, whether direct, indirect, incidental, special, exemplary, punitive, or consequential (including those arising from negligence), loss of use, data, income, or profit, damage to property, wasted management or office time, breach of contract, third-party claims, or any other losses of any nature, even if Taya has been informed of the potential for such damages or losses. This liability limitation encompasses issues such as the transmission of disabling devices or viruses that might impact your equipment, failures in mechanical or electrical systems, communication disruptions (e.g., issues with your internet service provider), unauthorized access, theft, personal injury (except due to our negligence), property damage, operational errors, strikes, or acts of God related to Taya. This includes, but is not limited to, any loss of revenue, income, profits, contracts, business, anticipated savings, goodwill, data, wasted management time, and any other type of loss or damage, regardless of its origin or foreseeability.
15.Indemnity
You agree to defend, indemnify, and hold Taya, along with its parent company, officers, directors, employees, and agents, harmless from any and all claims, damages, obligations, losses, liabilities, costs or debts, and expenses (including but not limited to legal fees) arising from: (i) your use of and access to the Taya Service; (ii) your violation of any term of these Terms of Service; (iii) your infringement of any third-party rights, including but not limited to copyright, property, or privacy rights; or (iv) any claim that one of your User Status Submissions has harmed a third party. This duty to defend and indemnify will persist even after these Terms of Service terminate and after you stop using the Taya Service.
16.Legal Jurisdiction
This Agreement will be governed by and interpreted in accordance with the laws of Hong Kong, without regard to conflict of laws principles. Any disputes arising from or related to these terms, including questions concerning their existence, validity, or termination, will be resolved through arbitration managed by the Hong Kong International Arbitration Centre ("HKIAC") in accordance with the current Arbitration Rules of the HKIAC, which are deemed incorporated by reference into this provision. The arbitration will occur in Hong Kong, and the proceedings will be conducted in English.
17.Amendments
We reserve the right to amend these terms and will provide you with an opportunity to review and comment on the revised terms before you continue using our Services. We may inform you on the Website if we make changes to policies, guidelines, or other terms referenced in or included by this Statement.
